ENWe appreciate all of you for using the products and services of Fourth Valley Concierge Corporation (“FVC”). These Terms of Use (the “Terms”) set forth the conditions for using all services provided by FVC (collectively, the “Services”). The Terms consist of (i) general rules applicable to all customers using the Services and (ii) individual rules applicable to each service. We kindly ask that you review these Terms carefully prior to using the Services.
1. General Rules
1.1 Definitions
(1) Job Seeker: A person who has registered as a User on Connect Job for Candidate. Job Seekers may use the Connect Job for Candidate website.
(2) Recruiting Company: A business entity that has registered as a User on Connect Job for Employers. Recruiting Companies include staffing/recruiting companies that introduce candidates to Recruiting Companies and may use the Connect Job for Employers website.
(3) Connect Job for Candidate: An online platform for Users through which FVC, via a website called “Connect Job” operated by FVC, provides functions such as offering job postings from Recruiting Companies.
(4) Connect Job for Employers: An online platform for Recruiting Companies through which FVC, via a website for Recruiting Companies operated by FVC, provides functions such as offering Users’ Job Seeker information to Recruiting Companies.
(5) Connect Job System or the System: A collective term for Connect Job for Candidate and Connect Job for Employers.
(6) Connect Job Placement Service: A job-placement type service in which FVC, based on hiring requirements presented by Recruiting Companies, screens Job Seekers, arranges interviews, supports applications, coordinates offers, etc., as well as providing the Connect Job Talent Database Service. Job Seekers’ Personal Information (name, email address, phone number, etc.) will be provided at the stage leading to interviews/selection. This
(7) Connect Job Talent Database Service: A simplified service in which FVC provides companies with a list of Attribute Information (defined hereafter, including Job Seekers’ Personal Information), and Recruiting Companies independently contact Job Seekers directly. FVC will not provide support such as arranging or coordinating interviews after Job Seeker selection.
(8) User: All individual Job Seekers and Recruiting Companies that have registered an account in the Connect Job System. Depending on the context, this may refer to both Job Seekers and Recruiting Companies, or to either Job Seekers or Recruiting Companies.
(9) CV: Abbreviation for Curriculum Vitae; it is a document describing personal attributes, educational background, and employment history, which Job Seekers upload to the website of Connect Job for Candidate.
(10) Personal Information: Information relating to an individual User that can identify the individual by name, address, phone number, email address, school name, or other descriptions, including information that cannot identify the individual by itself but can be easily collated with other information to identify the individual.
(11) Attribute Information: Information about a Job Seeker that does not include direct identifiers such as name or phone number and does not identify an individual by itself.
(12) Provision to Third Parties: The act of providing a Job Seeker’s Personal Information or Attribute Information obtained by FVC to a third party.
1.2 User Registration
If a User wishes to use Connect Job, the User shall complete user registration in accordance with FVC’s prescribed user registration procedures.
1.3 Personal Information
In providing Personal Information to FVC, Users agree to the following:
(1) Administrator of Personal Information
a. Registered Personal Information is managed by FVC (CEO: Yohei Shibasaki). FVC’s policy for handling Personal Information is as set forth separately in the “Privacy Policy” and “Handling of Personal Information.”
b. Personal Information is managed responsibly by the following person in charge of personal information management:

(2) Purpose of use
Personal Information provided by Users or obtained by FVC in the course of the Services will be used by FVC, and in principle will not be used for purposes other than the following:
a. Operation and administration of the Services and ancillary services (including responding to inquiries);
b. Analysis or examination of data necessary to improve the Services;
c. User authentication, delivery of direct messages (DMs) from Recruiting Companies; telephone invitations to seminars, and providing information and notices regarding services, seminars, events, campaigns, and other offerings provided by FVC or |FVC’s partners, etc.;
d. Creating statistical data in a form that does not identify individuals based on the received Personal Information and using such data without limitation;
e. Registration, classification, processing, and provision of Attribute Information to the extent necessary for operation of the Connect Job Talent Database Service;
f. Provision to Third Parties based on Job Seekers’ consent (including transfers outside Japan);
g. Support for residence status applications, visa acquisition assistance, immigration entry procedures, employment authorization procedures, and related matters;
h. Prevention of unauthorized or fraudulent use, ensuring security, and responding to incidents and other issues; or
i. Other purposes of use indicated at the time of acquisition.
(3) Provision to Recruiting Companies
Personal Information posted or generated through use of the official website of the Services (including entries submitted by Users) will be provided to Recruiting Companies or events related to the Services, within the scope necessary for operating the Services. Provided Personal Information will be managed by each company for purposes such as communications in the selection process for internships and recruitment activities after entry. For details concerning the handling of personal information, please contact the relevant company directly. Recruiting Companies are prohibited from using Personal Information obtained through the official website of the Services for any purpose other than internships or recruitment activities.
(4) Provision of Personal Information to External Service Providers
When FVC uses services provided by other companies (including skill assessments, aptitude tests, and other services) to enhance the value of the Services or improve matching accuracy, FVC may provide Users’ Personal Information to such service providers only to the extent necessary to achieve the purpose.
(5) Provision to Third Parties other than Recruiting Companies
In principle, FVC will not provide registered Personal Information to third parties other than Recruiting Companies without Users’ consent. However, in the following cases, FVC may disclose registered details without consent to the extent not contrary to applicable laws and regulations:
a. When required by laws and regulations;
b. When necessary to protect a person’s life, body, or property and it is difficult to obtain the individual’s consent;
c. When particularly necessary to improve public health or promote sound development of children and it is difficult to obtain the individual’s consent; or
d. When it is necessary to cooperate with a national or local government agency (or a person entrusted thereby) in performing duties prescribed by laws and obtaining the individual’s consent may impede the performance of such duties.
(6) Scope of “Third Party”
If any of the following applies, the recipient of Personal Information shall not be deemed a “third party” for the purposes of the preceding paragraph:
a. When FVC entrusts all or part of the handling of Personal Information within the scope necessary to achieve the purpose of use; or
b. When Personal Information is transferred due to succession of business by merger or other reasons.
(7) Connect Job Talent Database Service
With a Job Seeker’s consent, FVC will register, in addition to Personal Information, the following Attribute Information items in the Connect Job Talent Database Service and provide information in a form searchable/viewable by Recruiting Companies:
(i) Attribute Information items provided
(ii) Form of provision
Recruiting Companies may view the Attribute Information using search and filtering functions provided by FVC.
(iii) Handling of Personal Information
In the Connect Job Talent Database Service, FVC will provide Recruiting Companies with information that can identify an individual, such as name, telephone number, and email address, to the extent necessary for interviews and the selection process.
(iv) Job Seeker’s consent
Job Seekers shall confirm in advance and agree that Attribute Information will be registered in and provided to Recruiting Companies through the Connect Job Talent Database Service. Job Seekers understand and agree that FVC’s provision of Job Seekers’ information to Recruiting Companies may constitute Provision of Personal Information to Third Parties.
(8) Cross-border transfer
With respect to Personal Information of Job Seekers who use the Services from outside Japan, FVC will transfer such information to locations in and outside Japan only if any of the following applies. FVC may provide such information to domestic or overseas subcontractors (including cloud service providers, affiliated companies, business partners, etc.):
(i) Transfer to a country/region that has received an adequacy decision;
(ii) Implementation of appropriate safeguards (e.g., standard contractual clauses);or
(iii) Explicit consent from the Job Seeker.
(9) Supervision of contractors
When entrusting all or part of the handling of Personal Information, FVC will provide necessary and appropriate supervision of the contractor so that safe management of the entrusted Personal Information is ensured.
(10) Contact
FVC will endeavor to respond appropriately and promptly to complaints and consultations regarding the handling of Personal Information. FVC will also accept requests for disclosure, etc. (notification of purpose of use, disclosure, correction/addition/deletion, suspension of use or provision to third parties), regarding disclosable Personal Information held by FVC. (11) Failure to provide Personal Information
If Users do not enter items required for each service in the Services, some services may not be available.
(12) Acquisition of information by methods not easily recognizable by the individual
a. Based on information such as Profiles, FVC may create numerical data and statistical data in a form that does not identify Job Seekers, and may use such statistical data without limitation (including proposals to Recruiting Companies and market research, without limitation).
b. FVC may use technologies such as cookies and JavaScript to obtain non-identifying Attribute Information such as age, gender, occupation, and area of residence (limited to information that cannot identify an individual even when combined), as well as Job Seekers’ behavior history within the website (URLs accessed, content, reference order, etc.). Cookies and behavior history do not contain any Personal Information.
c. FVC may use non-identifying information obtained pursuant to the preceding paragraph, such as Attribute Information and behavior history, without limitation.
(13) Disclaimer
In the following cases, FVC bears no responsibility for the acquisition of Personal Information by a third party:
a. When Users themselves disclose Personal Information to a specific company using the functions of the Services or other means; or
b. When the individual is unintentionally identified based on registered details other than personally identifiable information.
1.4 Refusal of Posting and User Registration
FVC may, at its discretion, refuse an application for user registration if any of the following applies:
(1) The User does not agree to these Terms;
(2) The User applies with false information;
(3) The User has previously been subject to forced cancellation of registration due to violation of these Terms or other terms;
(4) The User is a member of, or related to, anti-social forces; or
(5) FVC otherwise deems the application inappropriate, including where, as a result of the review conducted by FVC in response to the application set forth in Section 1.2, FVC determines the application to be inappropriate.
1.5 Preparation of Usage Environment
Users shall, at their own responsibility and expense, properly prepare PCs and other communication devices, communication means, etc., necessary to use the System.
Users shall take security measures to prevent unauthorized access and information leakage, etc., in accordance with their usage environment.
FVC will not be involved in Users’ usage environment and bears no responsibility for it.
1.6 Damages
If a User violates these Terms and causes damage to FVC or a third party, the User shall bear liability to compensate FVC or the third party for all damages, directly or indirectly.
1.7 Changes to System Functions
FVC may, without prior notice to Users, change, suspend, or terminate all or part of the System functions for any reason.
1.8 Amendments to these Terms
Users acknowledge in advance that FVC may add or change functions of the Services at its discretion and that provision of the Services may be suspended or terminated due to unavoidable circumstances.
If a User uses the relevant Services after revision of these Terms or additional provisions, such revision shall form part of the contract between FVC and the User. Users who do not agree shall cease using the Services.
1.9 Suspension of Use for Maintenance
(1) FVC may temporarily suspend operation of the System without prior notice or consent from Users in any of the following cases, and Users agree in advance:
(a) Maintenance of servers related to the Connect Job System, change of specifications, or correction of system defects, etc.;
(b) When the operation of the Connect Job System becomes difficult or impossible due to the occurrence or threatened occurrence of natural disasters or other emergencies , or due to amendments or enactment of laws and regulations; or
(c) Other cases where FVC deems temporary suspension necessary due to unavoidable reasons.
(2) FVC shall not be responsible for any damages to Users or third parties arising from suspension under this section and will not refund any fees.
1.10 Deletion of Information after Deregistration
Users acknowledge that if they cease to be a Connect Job User due to deregistration or other reasons, all registered information on the System may be deleted and may no longer be viewable. However, FVC has no obligation to delete such information.
1.11 Prohibited Acts
(1) When using the Services or information obtained through the Services, Users must comply with regulations in the country/region of use, and FVC bears no responsibility for Users’ regulatory violations.
(2) In using the Services, the following acts (including acts that induce or prepare for them) are prohibited:
a. Acts violating laws, these Terms, or additional provisions;
b. Acts contrary to public order and morals;
c. Acts infringing rights of FVC or third parties;
d. Harassment, defamation, cyberstalking, encouragement of discrimination, or other acts causing nuisance to other Users;
e. Profit-making acts such as marketing, sales promotion, advertising, solicitation, recruiting users (except those approved by FVC), acts for meeting/dating persons of the opposite sex without acquaintance, or other acts using the Services for purposes different from those originally intended;
f. Acts that destroy or interfere with functions of software, hardware, servers, or networks of FVC or third parties;
g. Collecting other users’ Personal Information, registration information, usage history, etc., without permission, disclosing collected information to third parties, or using it for recruitment activities outside the Services, headhunting, or sales activities;
h. Using another User’s account to use the Services;
i. Transferring or lending one’s own account to a third party, or disclosing one’s own account and password to a third party;
j. Reverse engineering or attempting to extract source code of software included in the Services;
k. Using the Services to provide benefits, directly or indirectly, to anti-social forces;
l. Using bots or other automated programs to manipulate the Services improperly or to hinder other Users’ voluntary and reasonable choices;
m. Using Attribute Information or Personal Information of Job Seekers provided through the Connect Job Placement Service or the Connect Job Talent Database Service for purposes other than recruitment (including sale, diversion, redistribution, etc.);
n. Registering any false, misleading, or inaccurate information, or using the Services by impersonating any other person;
o. Contacting Users for the purpose of demanding money, committing fraud, or otherwise pursuing improper purposes, under the guise of job postings or recruitment activities;
p. Bulk obtaining or reproducing information posted on the Services by means of scraping, crawling, or other technical methods;
q. Circumventing the use of the Services, such as entering into transactions without using the Services directly with Job Seekers or Recruiting Companies learned of through the Services;
r. Infringing the copyrights, trademark rights, or other intellectual property rights of FVC or any third party;
s. Bypassing or attempting to bypass the Services’ security measures, or attempting unauthorized access;
t. Storing Job Seeker information obtained through the Services in the User’s own database; and
u. Other acts deemed inappropriate by FVC.
1.12 Measures against Violations
In the following cases, FVC may, without prior notice to the User, delete Users’ data, content, or accounts, or suspend provision of the Services to Users. If a User has registered multiple accounts, the same measures may be taken for all accounts:
a. When the User violates these Terms or applicable additional provisions, or when FVC deems there is a risk of violation;
b. When there is delay in payment of amounts due to FVC, or when the credit card or bank account designated as the payment method is suspended;
c. When the User has not completed FVC’s procedure for agreeing to these Terms;
d. When FVC deems that financial instability of the User has occurred, such as filing for bankruptcy, civil rehabilitation, corporate reorganization, special liquidation, or other insolvency procedures;
e. When the account is registered or used by anti-social forces or related persons, or when FVC deems there is a risk thereof;
f. When the User has not used the account for one year or more; or
g. Other cases where FVC deems it difficult to continue the contractual relationship with the User, such as loss of trust.
FVC shall have no obligation to explain to the User the reasons for any measures taken pursuant to this Section. FVC shall not be liable for any damages incurred by the User as a result of such measures.
1.13 Exclusion of Anti-Social Forces
(1) Users represent and warrant that now and in the future:
a. They are not a boryokudan (organized crime group) or related organization as defined in the Act on Prevention of Unjust Acts by Organized Crime Group Members, nor any other anti-social organization or force (collectively, “Anti-Social Forces”);
b. They will not use Anti-Social Forces and will not engage in similar conduct;
c. They have no relationship with Anti-Social Forces, such as providing funds or benefits or receiving benefits, and they will not be socially condemned for having such relationship;
d. They will not, by claiming to be Anti-Social Forces, engage in defamation, obstruction of business, unjust demands, or similar acts; or
e. Their officers and employees are not members of Anti-Social Forces.
(2) If Users discover any violation of the above, they shall immediately report it to FVC.
(3) If it becomes clear that a User falls under any item in paragraph (1), FVC may terminate the contract without notice. FVC is not liable for damages to the other party arising from such termination, and the User shall compensate FVC for damages if FVC suffers any.
1.14 Contact
(1) Users shall contact FVC regarding the Services by submitting an inquiry form placed appropriately within FVC’s website or by any other method specified by FVC.
(2) FVC will contact Users regarding the Services by posting on appropriate locations within FVC’s website or by other methods deemed appropriate.
(3) Users agree that FVC may send advertisements or promotional materials regarding FVC or its business partners to the email address registered by the User.
1.15 Governing Law and Jurisdiction
These Terms are governed by Japanese law. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court or the Tokyo Summary Court as the court of first instance.
1.16 Consultation
If any matters not provided for in these Terms or any doubts about interpretation of any clauses arise, Users and FVC shall consult in good faith to resolve them.
1.17 Supplementary Provisions
These Terms are effective from 2026/4/1.
2. Individual Rules
When using the following services, the respective provisions below apply.
2.1 Connect Job for Candidate
2.1.1 License
(1) License from FVC to Job Seekers
a. FVC grants Job Seekers permission to use the Services within the scope prescribed by FVC.
b. All rights in all content provided by FVC within the Services belong to FVC, and FVC does not grant Job Seekers any right to implement or license FVC’s patents, utility model rights, design rights, trademark rights, copyrights, protectable know-how, or other intellectual property rights (collectively, “Intellectual Property Rights”, including rights under Articles 27 and 28 of the Copyright Act of Japan).
c. Job Seekers may not reproduce, transmit, transfer, lend, adapt, or otherwise use the content of the Services by any means.
d. FVC does not grant Job Seekers the right to sublicense the Services.
e. If a Job Seeker loses their User status for any reason, including deregistration, the right to use the Services granted by FVC shall terminate.
f. FVC may change the effective period of the right to use the Services granted to Job Seekers at any time.
(2) License from Job Seekers to FVC
a. If a Job Seeker posts Personal Information necessary for job hunting activities using the Services (CVs, profiles, project reports, images, videos, etc.; collectively, “Profiles”), FVC may use such Profiles and/or grant licenses to third parties to use them, to the extent necessary for the following purposes:
b. In using Personal Information and Profiles registered by Job Seekers, FVC may hide part of the information or the display of the Job Seeker’s name. For example, for operation and smooth provision of the Services, Job Seekers agree that Recruiting Companies may use Profiles after FVC has selected necessary information for each purpose.
2.1.2 Management of User Accounts
(1) Each Job Seeker shall register and maintain only one user account, password, email address and other authentication information, etc. (collectively, “Account Information”) per person. One person may not hold multiple sets of Account Information, and multiple persons may not jointly maintain a single set of Account Information.
(2) Job Seekers shall bear responsibility for managing Account Information in all cases.
(3) Job Seekers may not transfer, lend, sell, or provide as security their user account to any third party.
(4) The provisions of items (1) through (3) do not apply where FVC separately approves.
(5) Job Seekers shall bear responsibility for any damages resulting from insufficient management, mistakes in use, or use by third parties, etc., of Account Informationg regardless of reason, and FVC bears no responsibility.
(6) If a Job Seeker’s account or password becomes known to a third party or there is a risk of use by a third party, the Job Seeker shall immediately notify FVC and follow FVC’s instructions if any.
(7) The Job Seeker agrees that any use of the Services made using the Job Seeker’s registered Account Information, shall be deemed to have been made by the Job Seeker.
(8) If FVC determines that the Account Information, is being used improperly or without authorization, FVC may suspend use of the relevant account.
2.1.3 Personal Information related to Job-Hunting Activities
(1) After becoming a User of the Services, Job Seekers shall post Profiles at their own responsibility and discretion within the scope of the posting standards prescribed by FVC.
(2) Job Seekers shall not include Personal Information of others in Profiles and agree that if Profiles contain any third party’s personal information, the relevant parts will be deleted or modified by FVC.
(3) When Job Seekers post Profiles or similar information, they will be made available to Recruiting Companies and will be accessible for viewing and searching by such Recruiting Companies. If any changes occur in Profiles, Job Seekers shall immediately update them.
(4) Job Seekers warrant to FVC the truthfulness and accuracy of the posted information and that it does not infringe any third party rights. If any dispute arises with a third party, the Job Seeker shall resolve it at their own cost and responsibility and shall not cause any inconvenience or damage to FVC. If FVC incurs any damages, the Job Seeker shall compensate FVC for such damages.
(5) If it becomes clear that Profiles violate posting standards or are contrary to fact, and if FVC determines that the Job Seeker is not using the Services appropriately, FVC has authority to take the following actions. FVC bears no liability for any damages thereby:
a. Request voluntary deletion or correction of Profiles;
b. Change the scope of disclosure of Profiles or make them non-viewable (private);
c. Delete or change all or part of the registered information without prior notice; or
d. Delete files uploaded by Job Seekers at FVC’s discretion.
(6) If Job Seekers post Profiles, the Job Seeker hereby agrees in advance that FVC may use such Profiles, to the extent necessary, for the purposes of managing, operating, improving, analyzing, and compiling statistics regarding the Services, and for other purposes related thereto.
(7) Job Seekers acknowledge that FVC has no obligation to store Profiles and shall back up necessary information at their own responsibility as appropriate.
(8) FVC may use Profiles for analysis for the purposes of matching, recommendations, or job referrals on the Services.
(9) The Job Seeker acknowledges and agrees that Profiles may be provided to or viewed by Recruiting Companies and companies that have job postings.
2.1.4 Provision of Information and Conducting Surveys
(1) Provision of information
a. FVC may provide Job Seekers with announcements of new system functions, advertising distribution, email newsletters, administrative communications necessary for operation of the Services, and other information.
b. If a Job Seeker notifies FVC by the prescribed method before or after that they do not wish to receive information, FVC will not provide such information except where necessary to provide the Services.
c. Regardless of whether a Job Seeker wishes to receive information, if FVC delivers emails to the registered email address and receives error notifications a certain number of times or receives complaints from third parties, FVC may remove the Job Seeker’s email address from the mailing list.
(2) Conducting surveys
a. FVC may conduct surveys, etc.,regarding the Services and their use, including application status, offer status, and job change status, after a Job Seeker ceases to be a Connect Job User.
b. In such case, Job Seekers provide information and opinions at their own responsibility and warrant the truthfulness and accuracy thereof to FVC.
c. FVC may use the results of such surveys, etc., or grant licenses to third parties to use them within the scope necessary for operation of the Services without prior consent of Job Seekers.
d. FVC may compile and use the results of surveys, etc., in the form of statistics that do not identify any individual.
e. FVC may publish the results of surveys, etc, as statistical data.
2.1.5 Disclaimers
(1) Job Seekers use the Services at their own risk, and FVC bears no responsibility for any actions taken using the Services or their results; provided, however, that this shall not apply where Job Seekers suffer damages due to reasons attributable to FVC.
(2) Damages arising from management or display of job listings
a. FVC may exclude or delete job listings from the website of the Services for any reason, and bears no responsibility for any damages arising from such exclusion or deletion.
b. FVC does not manage job listing information, Recruiting Companies, or their statements/actions, and does not warrant their legality, morality, reliability, accuracy, or availability, and bears no responsibility for them. Job Seekers acknowledge this and use the Services at their own responsibility.
c. The Connect Job System refers to Profiles and uses artificial intelligence to present to Job Seekers recommended Recruiting Companies as a good match, and to present to Recruiting Companies recommended Job Seekers. FVC bears no responsibility for damages to Job Seekers arising from whether or not they are presented to Recruiting Companies as recommended candidates.
d. The Services do not guarantee interviews, employment, or hiring. FVC bears no responsibility for Job Seekers’ inability to obtain interviews/employment or for not being hired.
e. FVC does not warrant that the content of the Services has no technical inaccuracies, typos, or misprints, or that no defects or failures will occur, and bears no responsibility for them.
f. FVC does not warrant the legality, morality, reliability, or accuracy of the content of external websites such as advertisements posted in the Services, and bears no responsibility for any deficiency thereof. FVC shall not be liable for any damages arising from the content of any external website.
g. FVC shall not be liable in any way for any interruption or suspension of the Services due to system maintenance, communication line failures, natural disasters, or other unavoidable circumstances.
h. FVC shall not be liable in any way for any loss of data due to system failures or other similar causes.
i. FVC does not guarantee the employment terms, salary, working conditions, or any other matters presented by Recruiting Companies.
j. FVC does not guarantee the acquisition of any status of residence or permission to work.
k. FVC is not a party to any employment contract between a Job Seeker and a Recruiting Company, and does not guarantee, nor assume any responsibility or liability for, the formation, terms, performance, or any other matters whatsoever relating to such employment contract.
(3) Disputes between Job Seekers and third parties
a. FVC is not involved in disputes between Job Seekers and Recruiting Companies or third parties, such as mediation of individual employment contracts regarding job information or disputes arising therefrom, or misuse by Recruiting Companies of information including Job Seekers’ Personal Information.
b. FVC bears no responsibility for any disputes between Job Seekers and other Job Seekers, Recruiting Companies, or other third parties arising from use of the Services (including the following cases), and Job Seekers must resolve them at their own cost and responsibility:
c. FVC bears no responsibility for interactions among Job Seekers, such as communications between Job Seekers outside the Services.
(4) Except where there is a reason attributable to FVC, FVC shall not be liable for any damages arising from or related to the following:
a. Job Seekers’ use or inability to use the Services;
b. Costs incurred by Job Seekers to conduct transactions, obtain information, or procure substitute services through the Services;
c. Unauthorized access to or alteration of Job Seekers’ transmissions (communications) or data;
d. Statements, transmissions (communications), or actions by third parties within the Services; or
e. other matters related to the Services and information provided by FVC
(5) Scope of compensation
FVC shall be liable for damages only up to the amount of direct and actual damages suffered by the Job Seeker. If these Terms or other terms constitute a “consumer contract” under the Consumer Contract Act of Japan (Act No. 61 of 2000), Article 2, paragraph (3), and FVC is liable for damages based on non-performance or tort, FVC shall not be liable for damages arising from special circumstances (including those foreseen or foreseeable) unless FVC has intent or gross negligence.
2.1.6 Deregistration
(1) Deregistration by Job Seekers
If a Job Seeker wishes to cancel registration as a Connect Job User, the Job Seeker shall submit a request for deregistration to FVC by the prescribed method.
(2) Deregistration by FVC
If a Job Seeker falls under any of the following, FVC may, at its discretion, take measures such as forced deregistration, deletion of all or part of profile information, and changes to the scope of disclosure. FVC bears no responsibility for any damages arising therefrom:
a. It becomes clear that the Job Seeker did not meet the user criteria prescribed by FVC at the time of registration;
b. Violation of these Terms or other terms;
c. Provision or registration of false information;
d. Acts that disadvantage Recruiting Companies, FVC, or third parties; inappropriate acts such as slander, insults, complaints, nuisance behavior, discriminatory remarks; or acts that damage honor or credibility;
e. Acts connected to crime;
f. Acts violating laws or public order and morals;
g. Acts obstructing operation of the Services or other services of FVC;
h. Where more than one year has elapsed after user registration and the Job Seeker has never logged into the System; or
i. Other cases where FVC deems inappropriate.
2.1.7 Waiver of Class Action Rights
In connection with use of the website of the Services, Job Seekers may not sue FVC as a plaintiff or class representative in a class action, nor may they participate as a party adverse to FVC in any form of class action against FVC.
2.2 Connect Job
Connect Job is a function of Connect Job for Candidate and provides job-search support to individual Job Seeker Users by FVC’s career consultants (the “Connect Job Agent”).
2.2.1 Eligible Users
All individual Job Seekers holding a Connect Job account may use Connect Job.
2.2.2 Application to Use Connect Job
Job Seekers may use Connect Job upon agreeing to these Terms.
2.2.3 Suspension of Use of Connect Job
Job Seekers may stop using Connect Job at any time through FVC’s prescribed procedures.
2.2.4 Consent to Job Support Activities by Connect Job Agent
Connect Job Agent may, on the Connect Job website and via emails addressed to individuals, provide various employment-related information, information on events hosted by FVC, and, upon engagement by from Connect Job user companies, provide individual client companies’ job openings or event invitations, request surveys, and conduct interviews/counseling by phone or online communication tools. The Job Seeker agrees that FVC may provide the support activities described above. However, because such activities may affect the Job Seeker’s rights and legal relationships, the Job Seeker shall, at his/her own discretion, edit the Job Seeker’s Profiles and submit applications for various job postings.
2.3 Connect Job for Employer
2.3.1 Holding Recruiting Company Accounts
(1) Each Recruiting Company shall hold one Account Information per company. Unless otherwise specifically approved by FVC, a company may not hold multiple Account Information, and multiple persons may not jointly hold one Account Information.
(2) Recruiting Companies bear all responsibility for the use, change, and management of the Account Information granted by FVC. Except where otherwise separately agreed between the Recruiting Company and FVC, Recruiting Companies may not allow third parties to use, or lend, transfer, assign, or provide as security such Account Information.
(3) If the Services are used with the Account Information granted to a Recruiting Company, such use shall be deemed use by the Recruiting Company itself even if used by a third party, and the Recruiting Company bears all responsibility for such use for any reason; provided, however, that this shall not apply where attributable to FVC.
2.3.2 Application
(1) After user registration, when the Recruiting Company agrees to all of these Terms, the Privacy Policy, and additional provisions for Connect Job (including notes described in the application form, etc.) without reservation, and after FVC completes the prescribed contract review and notifies the Recruiting Company that it accepts the application, a contract for use of Connect Job for Employer (the “CJE Contract”) shall be formed between FVC and the Recruiting Company, and the use of Connect Job shall commence.
(2) FVC will conduct a contract review in accordance with its prescribed standards when a Recruiting Company applies to use Connect Job for Employer, when a Recruiting Company applies for a paid plan, and when a certain period has elapsed in the Recruiting Company’s use. In conducting the review, FVC may inquire about business details or request provision or presentation of necessary documents.
(3) The contract review standards may change depending on amendments of laws, the Recruiting Company’s usage status, social conditions, etc. The standards are not disclosed. FVC may not answer inquiries regarding the details or results of the review.
(4) FVC may refuse User’s use of the Services based on the results of the review above.
2.3.3 Fees
(1) Recruiting Companies shall pay prescribed fees for paid services in the Services by the deadline and method specified by FVC.
(2) If fees are not paid by the deadline, FVC may claim late payment charges at an annual rate of 14.6% from the day after the deadline until payment is made.
(3) FVC may collect, in addition to fees, taxes that FVC must collect pursuant to laws and pay to tax authorities (including consumption tax, without limitation) at the tax rate or amount applicable from time to time.
(4) FVC will determine whether consumption tax is domestic or foreign based on the address notified to FVC at the time of application, and if issues arise in collection due to an incorrect address, the User shall bear responsibility.
2.3.4 Non-Refund of Fees
Even if posting based on the Services ends during the posting period for any reason, including termination of the CJE Contract, FVC will not refund any fees already received from the Recruiting Company. Unless otherwise provided, the Recruiting Company shall also remain obligated to pay any unpaid portion of the agreed fees.
2.3.5 Copyright
(1) Unless otherwise provided in these Terms or the CJE Contract, copyrights and other Intellectual Property Rights and other property rights in information provided by FVC through the Services (including compilations) belong to FVC.
(2) Intellectual Property Rights in each content included in job listings (including information, documents, photos, images, videos, software, etc.) belong to FVC, except for those for which the Recruiting Company has pre-existing intellectual property rights, and the Recruiting Company shall not exercise moral rights of authors with respect thereto.
2.3.6 Confidentiality
(1) Recruiting Companies and FVC shall not, without prior written consent, use for purposes other than the intended purpose such as recruitment selection, nor disclose to any third party (excluding subcontractors as provided in these Terms) any information that constitutes the other party’s business or technical secrets learned in connection with the Services (including posting contents; collectively, “Confidential Information”) and Personal Information. The list of Job Seekers provided under the Connect Job Talent Database Service must also not be used for purposes other than recruitment activities nor re-provided to third parties. However, the following information is excluded from Confidential Information:
a. Information already held by the recipient or already public at the time of disclosure, or that becomes public after disclosure through no fault of the recipient; and
b. Information lawfully obtained by the recipient from a third party without confidentiality obligations.
c. Where required by laws and regulations or by a court order.
(2) This section shall survive after the posting ends.
2.3.7 Disclosure, Publication and Use of Job Information
(1) Notwithstanding the preceding section, if a Recruiting Company posts job information on the Services operated by FVC based on an application form, the Recruiting Company agrees in advance that the posted job information may be posted on portal sites, etc. of third parties partnering with FVC in respective formats.
(2) FVC may aggregate and analyze company information and job information provided by Job Seekers in the Services, page views and other usage records, etc., create statistical data, etc., after processing so that individuals cannot be identified, and use such data without limitation.
2.3.8 Obligations of Recruiting Companies
(1) If Recruiting Companies receive questions, applications, registrations, or other communications from Job Seekers through the Services, they shall promptly reply.
(2) If applications are made to job listings posted in the Services through the Services, Recruiting Companies shall promptly and explicitly inform Job Seekers of selection results or acceptance/rejection.
(3) Except with prior written consent of FVC, Recruiting Companies shall not reproduce, publish, transmit, distribute, transfer, lend, translate, adapt, license, reprint, or reuse content in which FVC holds Intellectual Property Rights. Recruiting Companies may not grant sublicenses for reuse of the Services.
(4) If a Recruiting Company violates the preceding paragraph, FVC has the right to enjoin posting of information and any use such as copying or reprinting the content.
(5) If Recruiting Companies provide FVC with photos, logos, documents, etc., to be used in posted information, Recruiting Companies warrant that such information does not infringe any third party Intellectual Property Rights or other rights and that the content is not contrary to fact.
(6) If there is any change in the Recruiting Company’s name, address, invoice delivery destination, etc., the Recruiting Company shall promptly notify FVC.
(7) When Recruiting Companies use the Services or information learned through the Services, they must comply with regulations in the countries/regions of use, and FVC bears no responsibility for Recruiting Companies’ regulatory violations.
(8) In creating job postings, Recruiting Companies shall ensure the content is not contrary to public order and morals, not anti-social, and not discriminatory, and shall comply with the laws and regulations, rules, and guidelines applicable in the relevant countries or regions, as well as industry-specific laws, regulations, and guidelines.
(9) Recruiting Companies shall clearly indicate the content of work to be performed, wages, working hours, and other working conditions (collectively, “Work Conditions”), and shall comply with the following:
a. Work Conditions to be indicated shall not be exaggerated;
b. Regarding working hours, indicate start/end times, overtime beyond prescribed hours, break times, holidays, existence of discretionary work system, etc.;
c. Regarding wages, indicate wage form, base salary, fixed allowances, commuting allowance, matters regarding raises, etc. If adopting fixed overtime pay, indicate the calculation method (with clarifying fixed overtime hours and amount), base salary excluding fixed overtime pay, and that additional premium wages will be paid for overtime beyond fixed hours, holiday work, and late-night work;
d. If some Work Conditions will unavoidably be indicated separately later, indicate that fact as well;
e. To help candidates understand, limit the level and scope of Work Conditions as much as possible;
f. Indicate Work Conditions as concretely and in as much detail as possible, including workplace environment;
g. If there is a possibility that the indicated Work Conditions may differ from those at the time of concluding the employment contract, indicate that fact as well; and if Work Conditions differ from what was already indicated, promptly inform candidates as such; and
h. If Work Conditions during the probationary period and after the probationary period differ, indicate each.
(10) Recruiting Companies shall not obtain, reproduce, or collect Job Seeker information or any other information posted on the Services by means of scraping, crawling, or other automated methods.
(11) Recruiting Companies shall not use Job Seeker information obtained through the Services, without using the Services, for recruitment activities, headhunting, sales activities, or any other purposes.
(12) Recruiting Companies shall not store, accumulate, or reuse Job Seeker information obtained through the Services in their own database or any third party’s database.
2.3.9 Conducting Surveys
(1) FVC may conduct surveys regarding the Services and their use during or at the end of the contract with the Recruiting Company.
(2) In such case, Recruiting Companies shall provide information and opinions at their own responsibility and warrant their truthfulness and accuracy to FVC.
(3) FVC may use the survey results or license them to third parties within the scope necessary for operation of the Services without prior consent of the Recruiting Company.
2.3.10 Termination of CJE Contract
(1) If a Recruiting Company wishes to terminate the CJE Contract, it shall submit a request by FVC’s prescribed method.
(2) If a Recruiting Company falls under any of the following, FVC may immediately suspend posting and account or terminate the CJE Contract without prior notice, and the Recruiting Company shall automatically lose the benefit of time for payment regarding fees, etc., and all obligations of the Recruiting Company arising under the Services shall be accelerated and become immediately due and payable:
a. Violation of obligations under these Terms or the CJE Contract, etc.;
b. It becomes clear that the Recruiting Company notified false matters in the posting content;
c. Dishonor of a bill or check, or being in suspension of payments;
d. Attachment, provisional attachment, provisional disposition, or auction petition; or receiving delinquent tax disposition or other governmental action;
e. Filing for commencement of bankruptcy, civil rehabilitation, corporate reorganization, or special liquidation proceedings, etc.;
f. Substantial change in management entity or capital structure causing or likely to cause disruption to smooth business operation of FVC;
g. Legal violations or violations of public order and morals that make continued posting difficult;
h. Acts related to use of the Services by the Recruiting Company that damage or may damage the FVC’s credit or reputation;
i. FVC determines that the Recruiting Company’s method of using the Services deviates from the purpose, and the Recruiting Company does not respond to a corrective demand with a reasonable period set; or
j. Other cases where FVC determines that it is difficult to continue the posting, or if there is a risk thereof.
2.3.11 Automatic Renewal
Unless otherwise provided in additional provisions, the CJE Contract shall automatically renew upon expiration of the initial contract term. To refuse renewal, the Recruiting Company must complete FVC’s prescribed contract termination procedures (non-renewal procedures) in advance. If the Contract is automatically renewed due to failure to complete procedures, fees for the renewed period will arise.
2.3.12 Disclaimers
(1) FVC does not warrant that the following will be satisfied, and is not responsible for damages arising from the absence of any of them:
a. Legality, morality, reliability, accuracy, usefulness, and availability of Profiles submitted by Job Seekers, and certainty of interviewing and hiring Job Seekers;
b. That the Services contain no technical inaccuracies, typos, or misprints, or that no defects or failures will occur; or
c. Provision of the Services in the event of force majeure such as natural disasters or network failures.
(2) If disputes arise between Recruiting Companies and Job Seekers, other Recruiting Companies, or other third parties in relation to provision or use of the Services, FVC is not involved and bears no responsibility.
(3) If a Recruiting Company receives a claim from a third party or a dispute arises with a third party in relation to the Services, the Recruiting Company shall immediately notify FVC, handle the claim/dispute at its own expense and responsibility, and report progress and results to FVC. FVC is not involved and bears no responsibility.
(4) If FVC receives a claim from a third party or a dispute arises with a third party in relation to a Recruiting Company’s use of the Services, the Recruiting Company shall compensate FVC for amounts FVC is forced to pay and other damages, and FVC bears no responsibility.
(5) FVC is not a party to any employment contract between a Job Seeker and a Recruiting Company, and does not guarantee, nor assume any responsibility or liability for, the formation, terms, performance, or any other matters whatsoever relating to such employment contract.
2.3.13 Damages
(1) In addition to Section 1.11(2) of these Terms, if a Recruiting Company falls under any item in Section 2.3.10(2), or otherwise causes damage to FVC in connection with use of the Services, the Recruiting Company shall bear liability to compensate FVC for all damages, directly or indirectly.
(2) FVC will compensate the Recruiting Company for damages caused by FVC’s intent or gross negligence in providing the Services, including cases of violation of disclaimer provisions in these Terms.
(3) If FVC is obligated to compensate damages under the preceding paragraph or by application of law, the scope of damages shall be limited to ordinary damages actually incurred by the Recruiting Company (excluding special damages such as lost profits). The amount of damages to be compensated shall be capped at the total fees actually paid by the Recruiting Company to FVC during the most recent one year up to the time the damage occurred (or the contract period if less than one year).
